1. ACCEPTANCE OF TERMS

EL AMANECER (operating under the trade name "El Amanecer"), a company registered in Mexico with its address at Privada de Bugambilias N°15, Oaxaca, Oax. 70420 ("we," "us," "our"), provides the website http://www.elamanecerr.com (the "Website") and any related products or services that reference these Terms and Conditions (the "Terms").

By accessing and using our services (collectively, the "Services"), you ("you," "user") agree to be legally bound by these Terms. If you do not agree with any part of these Terms, you must immediately cease using our Services.

2. SERVICES AND ELIGIBILITY

4. REGISTRATION AND ACCOUNTS

To make purchases or use certain features, you may need to register. You warrant that the information provided is truthful, complete, and up-to-date. You are responsible for the confidentiality of your account and all activities conducted under it.

We reserve the right to suspend or cancel accounts that, in our judgment, violate these Terms.

5. PRODUCTS, PRICES, AND AVAILABILITY

* Description: We strive to accurately display the colors, features, and details of our handmade products. However, variations inherent to the manual process may occur, and on-screen images may not be exact.

* Availability: All products are subject to inventory availability. We may discontinue products at any time.

* Prices: Prices are displayed in Mexican Pesos (MXN) and include applicable VAT. We reserve the right to adjust prices at any time.

6. PURCHASE PROCESS AND PAYMENT

* Payment Methods: We accept payments via Visa cards and PayPal.

* Information: You warrant that the payment and shipping information provided is correct.

* Validation: We reserve the right to reject any order, limit quantities purchased per person, or cancel orders that show signs of error, fraud, or suspicious activity.

* Taxes: Tax charges (VAT) will be calculated and added to the purchase total.

7. SHIPPING AND RETURN POLICY

* Shipping: Shipping times and costs will be specified during the checkout process. We are not responsible for delays caused by the courier company or events beyond our control (force majeure).

8. SUBSCRIPTIONS (IF APPLICABLE)

* Free Trial: We offer a 30-day free trial for new users. At the end of this period, the subscription will be paused until upgraded to a paid plan.

* Renewal: Subscriptions do not automatically renew. We will contact you to offer renewal.

* Cancellation: You may cancel your subscription at any time by contacting us via email. Cancellation will be effective at the end of the current billing period.

* Fee Changes: We reserve the right to modify subscription fees, notifying you in advance.

9. PROHIBITED ACTIVITIES

When using our Services, you agree NOT to:

1. Use the Services for illegal or unauthorized purposes.

2. Infringe upon our intellectual property rights or those of third parties.

11. SERVICE MANAGEMENT

We reserve the right to:

* Remove or reject any content that, in our discretion, violates these Terms.

13. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

* Liability Cap: To the fullest extent permitted by law, our total liability to you for any claim arising from the use of the Services or products shall not, under any circumstances, exceed the total amount paid by you to us in the last two (2) months prior to the event giving rise to the claim.

* Indirect Damages: We shall not be liable for any indirect, incidental, special, or consequential damages (such as loss of profits or data) arising from the use or inability to use the Services.

14. INDEMNIFICATION

You agree to indemnify and hold harmless us, our officers, employees, and agents from any claim, loss, damage, or expense (including attorney's fees) arising from:

1. Your use of the Services.

2. Your breach of these Terms.

3. Any content you post.

4. The infringement of third-party rights.

15. TERMINATION

We may suspend or terminate your access to the Services immediately, without prior notice or liability, if we determine that you have violated these Terms.

16. GOVERNING LAW AND DISPUTE RESOLUTION

* Governing Law: These Terms shall be governed and construed in accordance with the laws of the United Mexican States.

* Negotiation: Both parties agree to attempt to resolve any dispute through informal negotiation for at least 30 days before initiating formal proceedings.

* Arbitration: Any dispute not resolved by negotiation shall be finally settled by arbitration under the Mexican Arbitration Center (CAM), in accordance with its rules. The place of arbitration shall be Oaxaca, Mexico, and the language shall be Spanish.

* Exception: Either party may seek injunctive relief (preliminary measures) from the competent courts of Oaxaca, Mexico, for claims related to intellectual property infringement or unauthorized use.

17. GENERAL PROVISIONS

* Assignment: We may assign our rights and obligations under these Terms.

* Severability: If any clause of these Terms is declared invalid, the remaining clauses shall remain in full force.

* Waiver: Our failure to enforce any provision does not constitute a waiver of that right.

* Entire Agreement: These Terms, together with the Privacy Policy and Return Policy, constitute the entire agreement between you and EL AMANECER.
